A gun trust is a revocable trust which is designed to own firearms and accessories.
Provisions: A properly designed gun trust should have the following provisions:
- A specific statement of the purpose of the trust
- Who can possess and use the guns
- No prohibited person may serve as trustee
- A complete list of all federal and state "disqualifiers."
- Prohibited trustees are removed and replaced automatically
WHAT CAN A GUN TRUST DO FOR ME?
Privacy
If you die or become disabled, your firearms will be part of your "probate estate." A Probate Court proceeding will be required to deal with your guns. Any member of the public can find out about the items in your collection and who will receive them.
Passing them on
You want your twelve year old child to someday inherit your gun collection. A gun trust provides a way to lawfully store them until your child is old enough to have them transferred to him or her.
Sharing NFA Items
An NFA item can never be handled or transported by anyone other than the registered owner. NFA items owned by trusts may be lawfully possessed, and used by any trustee or "manager" of the trust.
